Can UAE Banks Recover Unpaid Loans From You in India?

Quick answer: Yes. Since India’s notification of 17 January 2020, the UAE is a “reciprocating territory” under Section 44A of India’s Code of Civil Procedure, 1908. A bank holding a money judgment from a listed UAE court can file it for execution in an Indian District Court, which can attach the debtor’s assets in India.

Many people who leave the UAE with unpaid loans or credit cards believe the debt stays behind. For borrowers now in India, that is not a safe assumption. This guide from Tasheel Legal Consultancy in Dubai explains how UAE judgments are enforced in India, what a borrower can raise in defence, and why settling early can be the practical answer for both sides.

Can a UAE judgment be enforced in India?

Yes. A final money judgment from a UAE court named in India’s 2020 notification can be executed in India as if an Indian court had issued it. The creditor files the UAE decree for execution instead of starting a fresh lawsuit in India.

The route is open to UAE banks and to any other creditor with a qualifying UAE judgment, such as a company with unpaid invoices or an individual who lent money. Our service page on enforcing UAE judgments in India explains how we support creditors. This guide covers civil recovery only. Criminal matters, such as allegations of fraud, follow different rules and need separate advice.

What changed when India named the UAE a reciprocating territory?

On 17 January 2020, India’s Ministry of Law and Justice declared the UAE a “reciprocating territory” under Section 44A of the Code of Civil Procedure, 1908 (CPC). Since then, money decrees from the listed UAE courts can be executed directly by Indian District Courts. The notification covers:

Type of court Courts covered
Federal courts The Federal Supreme Court, and the Federal First Instance and Appeal Courts in Abu Dhabi, Sharjah, Ajman, Umm Al Quwain and Fujairah
Local courts The Abu Dhabi Judicial Department, Dubai Courts and the Ras Al Khaimah Judicial Department
Financial free zone courts The Abu Dhabi Global Market (ADGM) Courts and the Dubai International Financial Centre (DIFC) Courts

So a money judgment from Dubai Courts, or from a federal court in Sharjah, falls within the notification.

Which UAE judgments qualify for execution in India?

Only money decrees qualify under Section 44A, meaning judgments that order payment of a sum of money. A UAE judgment ordering a borrower to repay a credit card balance, a personal loan or an unpaid invoice is the typical example.

Two things are excluded: sums payable as taxes, fines or penalties, and arbitration awards. These follow different rules under Indian law, so take Indian legal advice on them.

What does a UAE creditor need before filing in India?

A creditor needs a final money judgment from a listed UAE court, a certified copy of it, and a certificate from the UAE court stating how far the decree has been satisfied.

  • A final judgment from one of the courts listed above.
  • A certified copy of the judgment issued by the UAE court.
  • A certificate of satisfaction from the UAE court, showing how much of the decree has been paid. If part of the debt was already recovered in the UAE, for example through a security cheque execution, the certificate should reflect this.
  • Information on the debtor in India, such as an address and known assets, which helps decide where to file.

A creditor still at the UAE stage should first secure an enforceable judgment. Our pages on debt collection in the UAE and filing an execution case in the UAE explain those steps.

How does execution work in an Indian court, step by step?

The creditor files an execution petition in the competent Indian District Court, which then executes the UAE decree as if it were its own.

  1. Obtain a certified copy of the final UAE judgment and the UAE court’s certificate of satisfaction.
  2. File an execution petition in the competent District Court, usually where the debtor lives or where the assets are located.
  3. The debtor can raise objections under Section 13 of the CPC (see the next section).
  4. If the objections fail, the court enforces the decree like an Indian decree, which can include attachment and sale of the debtor’s property in India.

The route is in use. In a reported decision of 17 March 2026 (CRP No. 480 of 2026), the Telangana High Court upheld execution in India of a money decree from a Sharjah federal court, including attachment and sale of the debtor’s Indian property. The execution petition is filed in India, usually through a lawyer qualified to practise there.

On what grounds can a borrower object in India?

An Indian court must refuse execution if the debtor proves one of the defences in Section 13 of the CPC:

  • the UAE court did not have jurisdiction;
  • the judgment was not given on the merits of the case;
  • it rests on an incorrect view of international law, or refuses to recognise Indian law where Indian law applies;
  • the UAE proceedings breached natural justice;
  • the judgment was obtained by fraud;
  • it upholds a claim based on a breach of Indian law.

The borrower must prove the defence. Anyone facing an execution petition in India should take advice from an Indian lawyer before relying on any of these grounds.

What if the bank has no UAE judgment yet?

Section 44A works only with a decree. If the bank has no UAE judgment yet, it would first need a final money judgment from a covered UAE court before it can use this route in India.

Leaving the UAE does not cancel the debt, so borrowers should not assume that no judgment today means no judgment later. You can check from abroad whether a case or travel ban exists in Dubai through the Dubai Police “Inquiry about Circulars and Travel Bans” service, which works with UAE Pass for people outside the UAE. For Abu Dhabi, the Abu Dhabi Judicial Department offers its “Estafser” service on its website and app. Before travelling back, read what to check before you return to the UAE after leaving with unpaid debt.

Can borrowers in India settle with a UAE bank instead?

Yes. You can contact the UAE bank from India and ask about restructuring or settlement at any stage, before or after a judgment. Any reduction is the bank’s decision, but a negotiated settlement can avoid execution proceedings in India.

  1. Check your status in the UAE: any case, judgment or travel ban.
  2. Write to the bank’s collections or recoveries team and ask about settlement. Under Central Bank of the UAE rules, banks must tell borrowers in arrears that credit counsellors are available (Consumer Protection Regulation Article 5.1.2.10).
  3. Agree the terms in writing: the accounts covered, the amount, the schedule, and what happens to any UAE case and any proceedings in India.
  4. Pay only through official bank channels and keep every receipt.
  5. Get a clearance or no-liability letter after the final payment, and make sure UAE files are closed and any Indian execution petition is withdrawn.

If someone in the UAE needs to act for you, a power of attorney signed in India usually needs notarisation in India, certification by India’s foreign ministry, legalisation by the UAE embassy or a UAE consulate in India, and attestation by the UAE Ministry of Foreign Affairs (MOFA). The UAE is not a party to the Hague Apostille Convention, so an apostille alone is not enough. Our page on settling a UAE bank debt explains the negotiation steps.

Frequently asked questions

Is the UAE a reciprocating territory for India?

Yes. By a notification dated 17 January 2020, India’s Ministry of Law and Justice declared the UAE a reciprocating territory under Section 44A of the Code of Civil Procedure, 1908. It covers the UAE federal courts, the Abu Dhabi Judicial Department, Dubai Courts, the Ras Al Khaimah Judicial Department, and the ADGM and DIFC Courts. Money decrees from these courts can be executed in India.

Does a UAE judgment need a new case in India?

Not for a money decree from a listed UAE court. The creditor files a certified copy of the UAE decree, with the UAE court’s certificate of satisfaction, in an Indian District Court, which executes it as if it were an Indian decree. The debtor can still object on the Section 13 grounds, such as lack of jurisdiction, fraud or a breach of natural justice.

Which Indian court enforces a UAE judgment?

A District Court in India. The creditor files an execution petition in the competent District Court, usually where the debtor lives or where the debtor’s assets are located, normally through a lawyer qualified in India. The court then executes the UAE money decree as if it were its own, subject to any Section 13 objections the debtor proves.

Can my property in India be attached for a UAE debt?

Yes, if the creditor holds a qualifying money decree from a listed UAE court and executes it in India. The District Court can enforce it like an Indian decree. In a reported decision of 17 March 2026, the Telangana High Court upheld execution of a Sharjah federal court money decree, including attachment and sale of the debtor’s property in India.

Can I settle a UAE bank debt from India?

Yes. You can write to the bank’s collections team from India, or appoint a representative in the UAE through a properly legalised power of attorney. Agree the terms in writing, pay only through official bank channels, and get a clearance or no-liability letter after the final payment. Make sure any UAE case is closed and any Indian execution petition is withdrawn.

Are UAE arbitration awards enforced under Section 44A?

No. Section 44A covers money decrees of the listed UAE courts only. Arbitration awards are excluded from it, and so are sums payable as taxes, fines or penalties. An arbitration award follows a different route under Indian law, so a creditor holding one should take Indian legal advice on how to enforce it.
