Quick answer: Possibly, but check first. Unpaid loans and credit cards are civil matters, and since 2 January 2022 a cheque that bounces only for lack of funds is not a crime. But a creditor may have a court case, execution file or travel ban waiting, and a ban could stop you leaving again. Check and settle before you fly.
Many former residents left the UAE owing money on a loan or credit card and now want to come back for work, family or travel. The answer depends on what has happened to the debt since you left. This post from Tasheel Legal Consultancy in Dubai explains what may be waiting, how to check from abroad, and how to settle without returning first.
Can you return to the UAE if you left with unpaid debt?
There is no single answer, because it depends on what the creditor did after you left. Not paying a loan or credit card is a civil matter, not a crime (see our guide on leaving the UAE with unpaid credit card debt). A bank can file a civil claim or a payment order and then enforce it, but it cannot impose a travel ban itself. Only a court or the Public Prosecution can.
A travel ban is designed to stop a person leaving, so if one is in place you may be unable to leave again until the debt is dealt with. If there is a criminal case or an arrest order against you, the risk is higher. Check your status and deal with the debt before you book a flight.
What could be waiting for you?
- Nothing yet. The bank may have written to you and reported the debt, but not gone to court.
- A civil case or payment order. The bank asks the court for a judgment or an order to pay.
- An execution file. Once there is a judgment, or a bounced security cheque, the creditor can enforce it. The court can order asset disclosure from banks, land departments and others, and attach assets.
- A travel ban. A creditor can ask the court for one if it fears you will leave. Under the Civil Procedure Law (Federal Decree-Law No. 42 of 2022), the debt generally has to meet a threshold of AED 10,000. During execution, the judge can impose a ban before notifying the debtor if the debtor is likely to abscond.
- Detention. This is not automatic. Dubai Court of Cassation decisions require the creditor to prove that the debtor can pay or is hiding assets.
- A criminal case. This applies only in specific situations, for example certain cheque offences (see below).
What happened to old criminal cheque cases after 2022?
Since 2 January 2022, a cheque that bounces only because there are not enough funds is no longer a crime. The holder recovers the money through the civil and execution courts. A cheque returned for “no funds” or “insufficient funds” can go straight to execution under the Commercial Transactions Law (Federal Decree-Law No. 50 of 2022).
Some cheque acts are still crimes, for example stopping payment without a legal reason, closing the account or withdrawing the balance so the cheque cannot be paid, or forgery. The Crimes and Penalties Law also says that if a law more favourable to the accused is issued before a final judgment, that law applies (Article 14). What happened to your own old case, especially one with a judgment before 2022, has to be checked on the case file. Do not assume it closed by itself.
How can you check your status from outside the UAE?
- Dubai: use the Dubai Police service “Inquiry about Circulars and Travel Bans” on the Dubai Police app or website. It uses UAE Pass and is open to people outside the UAE. It shows any ban or circular, the issuing authority and the case details.
- Abu Dhabi: use “Estafser” on the Abu Dhabi Judicial Department website or app to check travel bans, court cases and pending financial claims.
- Sharjah and the other federal courts: start with Ministry of Justice services, or ask us to check for you.
- Through a representative: if you cannot use these services, give a power of attorney to someone in the UAE who can make the enquiries for you.

Can you settle your debt without coming back?
In most cases, you can start from abroad. Central Bank of the UAE rules require banks to identify borrowers in difficulty and to tell borrowers in arrears that credit counsellors are available. Banks must also have procedures that prohibit undue or coercive pressure when collecting debts.
- Find out which creditor you owe, the amount it says is due, and whether there is a case number.
- Contact the bank and ask about restructuring or settlement, and ask for a credit counsellor.
- Agree the terms in writing before you pay.
- Pay through a traceable method and keep every receipt.
- Get a written clearance or no-liability letter from the bank.
- If there is a case, execution file or travel ban, have the proof filed and ask for it to be closed or cancelled.
- Check your status again before you travel.
If someone in the UAE will negotiate or file papers for you, you normally give them a power of attorney. You can make one at a UAE embassy or consulate, or in your home country followed by legalisation and attestation by the UAE Ministry of Foreign Affairs. See our power of attorney online service.
Is a travel ban lifted automatically once you pay?
Usually not. Automatic lifting is confirmed only for a few cases: Federal Public Prosecution bans for “eligible individuals” (Ministry of Justice, 2024), Dubai Public Prosecution criminal fines paid through Smart Fine Payment, and Dubai rent-dispute bans paid online through Dubai Police. For bank and other civil debts, the ban usually ends when proof of full payment is filed in the case, the creditor consents in writing, or the amount is deposited with the court. Someone has to file that proof and ask for the ban to be cancelled.
Which documents prove the debt is closed?
- The signed settlement agreement
- Payment receipts and bank transfer records
- A clearance or no-liability letter from the bank
- Confirmation that the case or execution file is closed
- A fresh status check showing no ban or circular
Keep copies with you when you travel, in case questions come up.
Do UAE debts expire?
There are time limits, but do not assume an old debt has gone. Which limit applies depends on the type of debt and whether a case was already filed:
- Commercial claims between traders are time-barred after 5 years.
- A domestic judgment can be enforced for 15 years.
- The new Civil Transactions Law (Federal Decree-Law No. 25 of 2025, in force since 1 June 2026) changed several civil limitation periods, so older guidance may be out of date.
Because periods still running on 1 June 2026 moved to the new rules, your dates need checking against your own documents.
Can the bank pursue you in your home country?
In India, yes. Since India’s notification of 17 January 2020, a money judgment from the listed UAE courts, including Dubai Courts, the Abu Dhabi Judicial Department and the federal courts, can be executed in an Indian District Court under Section 44A of India’s Code of Civil Procedure. The court can refuse on limited grounds, such as fraud or a breach of natural justice. See our UAE judgment enforcement in India service, and our guide on how UAE banks recover unpaid loans in India. For other countries, the rules depend on that country’s law.

Frequently asked questions
How do I check if there is a case or travel ban against me before I fly?
For Dubai, use the Dubai Police “Inquiry about Circulars and Travel Bans” service with UAE Pass, which is open to people outside the UAE. For Abu Dhabi, use the ADJD “Estafser” service. For Sharjah and the other federal courts, start with Ministry of Justice services. A representative with your power of attorney can also check for you.
Can I settle my UAE debt from abroad?
In most cases, yes. Contact the bank, ask about restructuring or settlement, and ask about credit counsellors, which Central Bank rules require banks to tell borrowers in arrears about. Agree the terms in writing, pay traceably, and get a clearance letter. If there is a case or ban, the proof must be filed so it can be closed.
Will I be arrested at the airport for an old bounced cheque?
Since 2 January 2022, a cheque that bounced only for lack of funds is not a crime. But some cheque acts are still crimes, such as closing the account so the cheque cannot be paid, and old cases need checking on the file. A civil travel ban could also stop you leaving. Check your status before you travel.
Do UAE debts expire after some years?
There are time limits, but they depend on the type of debt and whether a case was already filed. Commercial claims between traders are time-barred after 5 years, and a UAE judgment can be enforced for 15 years. The new Civil Transactions Law, in force since 1 June 2026, changed several civil limitation periods. Do not assume your debt has expired without checking your documents.
How do I get a clearance or no-liability letter after settling?
Ask the bank for a written clearance or no-liability letter once you have paid the agreed amount, and make it part of the settlement terms before you pay. Keep it with your receipts. If there is a court case or travel ban, the letter and receipts need to be filed in the case so it can be closed.
Can a legal consultant in the UAE negotiate for me while I am outside the country?
Yes. With a power of attorney, a UAE legal consultant can check your status, negotiate with the bank, and prepare the papers to close cases and cancel bans. You can make the power of attorney at a UAE embassy or consulate, or in your home country with legalisation and MOFA attestation. Legal consultants do not appear in court, so where court representation is required, licensed advocates handle it.
